The legislation provides for the time during which it is prohibited to make noise, engage in repair work, listen to music loudly, rearrange furniture.
Norms in the living quarters
There is a maximum permissible noise level in living quarters, the value of which should not be exceeded due to the negative impact on human health.
The human ear perceives a multitude of sounds, but on average this value is limited to 130 dB (an airplane taking off). Exceeding this mark can cause damage to the eardrum and hearing impairment.
The law determines the permissible norms in an apartment during the day and at night. During the day it is 40 dB, at night – 30 dB. Night time is the interval from 11 pm to 7 am. These values are better perceived when compared with other known sounds:
- 65 dB – talk in medium tones;
- 160 dB – the one of a shot from a gun;
- 80 dB – alarm clock.
The law also provides a break for rest from 13 to 15 hours. Any loud sounds are prohibited at this time. On holidays and weekends, it is prohibited to exceed the level of 40 dB from 10 am to 10 pm.
Repair work can be carried out only on weekdays from 9 am to 7 pm, their duration should not be more than 6 hours. A lunch break during which work is stopped must be at least an hour. Repair lasting more than 3 months is considered illegal.
Most citizens do not know how many decibels are allowed in living quarters at night and in the afternoon, so they often disturb other people’s peace.
Noisy neighbors break the law
Violators to administrative responsibility may be brought by sanitary-epidemiological service. When applying you need to provide evidence of administrative violation. When neighbors are not controlled, it is advisable to write a statement and call the police to record what happened in the protocol. Upon request, these materials are transferred to the administrative commission.
Another proof can serve as an act of exceeding the permissible noise in decibels, drawn up by a specialist. Experts measure the sound background with a sound level meter and accurately determine the violation of the norm. Making a sound is prohibited not only in the premises, but also in the following places:
- attics, technical floors, basements, corridors of apartment buildings;
- yard areas;
- land plots of owners;
- educational institutions, hospitals, etc.
If a violation is recognized, neighbors may be penalized. If violators rent housing and continue to disturb the peace of other people, then when they go to court there is a possibility that they will be evicted. In cases where citizens do not allow to live in peace, and the law cannot influence them, you can try to sell a house or consider an equivalent exchange of apartments.
